Terms and Conditions of Use

Access to and use of any element of the ARC–IELP system implies acceptance of these Terms. In the event of a separate service agreement, that contract shall prevail over this document.

System Identity

This document governs access to and use of the website, forms, interfaces and any digital interaction point of the ARC–IELP system, operated by Zabdiel Alejandro Vázquez González, a self-employed individual with business activity (hereinafter "THE OPERATOR").

ARC–IELP is an aggregate organizational analysis system designed to interpret structural conditions of organizational configuration.

Acceptance of Terms

Access, navigation or use of any element of the ARC–IELP system constitutes express acceptance of these Terms and Conditions.

If you do not agree with these terms, you must refrain from using the site or providing any information through it.

Nature of the System

ARC–IELP generates aggregate structural readings oriented toward organizational-level decision-making.

The system does not constitute or operate as
  • a labor audit or employment assessment
  • an individual evaluation of persons
  • a disciplinary tool
  • the issuance of judgments about individuals
  • a substitute for organizational or managerial decisions

Permitted Use

Users agree to use the system in accordance with its nature and purpose.

The following are expressly prohibited
  • attempting to manipulate, alter or distort the information provided
  • attempting to identify individuals from aggregate results
  • using the information for disciplinary, punitive or individual purposes

Misuse of the system may result in restriction or cancellation of access.

Information Provided

The user acknowledges that the quality of the system's outputs depends on the accuracy, consistency and conditions under which information is collected.

ARC–IELP interprets the information received without altering its nature.

Intellectual Property

The architecture of the ARC–IELP system, its processing logic, methodology, analytical models, interpretation framework and any associated technical or conceptual element are the exclusive property of THE OPERATOR.

The following are expressly prohibited
  • reproducing, replicating or adapting the system
  • inferring its internal logic or methodology
  • developing analogous systems based on its logic
  • using results as a basis for methodological reconstruction

Limitation of Liability

THE OPERATOR shall not be liable for:

  • decisions made by the user based on the generated information
  • incorrect or partial interpretations of system outputs
  • misuse of the system
  • organizational, legal or economic consequences arising from use of the results

Use of Information

The information generated by the system is aggregate, anonymized and non-identifiable.

The user acknowledges that such information:

  • cannot be used to identify individuals
  • does not constitute individual evidence
  • must be interpreted exclusively at the organizational level

Contractual Relationship

Use of the website or forms does not in itself constitute a contractual relationship.

In the event that the user or organization enters into a service agreement with THE OPERATOR:

  • that contract shall govern the commercial relationship
  • it shall establish specific conditions for use of the system
  • it shall define additional scope, obligations and limitations

Contract Precedence

In the event a service agreement with ARC–IELP is executed, that agreement shall prevail over these Terms and Conditions with respect to all matters relating to system use, information handling, commercial conditions and service operation.

These Terms and Conditions shall continue to apply only to matters not expressly regulated by the applicable service agreement.

Modifications

THE OPERATOR reserves the right to modify these Terms and Conditions at any time, arising from changes to the system, operating model or applicable law.

Any modifications will be made available through the official channels of the ARC–IELP system.

Governing Law and Jurisdiction

For the interpretation and enforcement of these Terms and Conditions, users submit to the laws and competent courts of Torreón, Coahuila de Zaragoza, Mexico, waiving any other jurisdiction that may apply to them.
